These Terms govern your access to and use of Convershun and its services.

Clear expectations make better business relationships. These Terms explain the responsibilities that come with using Convershun while keeping the essentials easy to find.

Acceptance of Terms

These Terms of Use ("Terms") are a binding agreement between you and Convershun. By accessing the website, creating an account, or using any Convershun service, you confirm that you have read, understood, and agree to follow these Terms.

If you use Convershun on behalf of a company or other organization, you represent that you have authority to accept these Terms for that organization. If you do not agree, do not access or use the services.

Description of Services

Convershun is a software platform designed to help businesses attract, organize, communicate with, and schedule prospective customers. Depending on your plan and the features available to your account, the services may include:

  • Lead generation tools and hosted lead forms
  • Lead inbox and pipeline management
  • Automated email communications and follow-up sequences
  • Appointment scheduling and public booking pages
  • Business reporting and analytics
  • Integrations with third-party advertising, email, and calendar platforms
  • AI-assisted content suggestions and other business growth tools

Convershun may improve, replace, add, or discontinue features as the platform evolves. Feature availability may vary by subscription plan, location, integration status, or technical requirements.

User Accounts

You must provide accurate, current, and complete account and business information. You are responsible for keeping that information updated, protecting your login credentials, and promptly notifying us if you suspect unauthorized account access.

You are responsible for activity performed through your account, including activity by employees, contractors, or other authorized users you invite. You may not share access with anyone who is not authorized to act for your business.

Subscriptions and Billing

Convershun may offer monthly and annual subscription plans. By starting a paid subscription, you authorize us or our payment provider to charge the applicable subscription price, taxes, and fees using your selected payment method.

Subscriptions automatically renew for the same billing period unless cancelled before the renewal date. You may cancel through the available account or billing controls, or by contacting support when self-service cancellation is unavailable. Cancellation prevents future renewals but does not erase charges already incurred.

We may change pricing or plan features in the future. When required, we will provide notice before a pricing change applies to a subsequent renewal. Any refund, credit, or billing adjustment is determined under the terms presented at purchase and applicable law.

Acceptable Use

You may use Convershun only for legitimate business purposes and in compliance with law.

You may not use the services to:

  • Send spam or facilitate fraudulent, deceptive, abusive, or illegal activity
  • Upload or contact people from lists obtained or used without lawful permission
  • Attempt unauthorized access to accounts, systems, networks, or data
  • Violate a third party's rights, platform policies, or contractual restrictions
  • Introduce malicious code or interfere with platform security or performance
  • Copy, reverse engineer, decompile, or attempt to discover non-public platform code

We may limit or suspend access when we reasonably believe use of the platform threatens users, third parties, Convershun, or the integrity of the services.

Lead Ownership and Responsibility

As between you and Convershun, you retain ownership of your leads, uploaded content, and business information. You are responsible for the accuracy, lawfulness, and handling of that information, including how your team contacts and serves each lead.

Convershun provides tools, not guaranteed business outcomes. We do not guarantee any specific lead volume, lead quality, appointment count, advertising performance, conversion rate, revenue, or profit.

Marketing Compliance and Consent Responsibilities

You are responsible for obtaining and documenting any consent required before sending calls, emails, text messages, advertisements, or other communications. You must promptly honor unsubscribe and opt-out requests and maintain practices that comply with applicable advertising, privacy, consumer protection, and communications laws.

Convershun provides communication and automation tools for lawful business use. Convershun does not provide legal advice, determine whether a particular campaign is lawful, or guarantee compliance with any regulation. You should obtain qualified legal guidance for your specific business, audience, and jurisdiction.

Third-Party Integrations

Convershun may connect with services operated by third parties, including Meta, Google, email providers, calendar providers, payment processors, and other business platforms. Your use of a third-party service is also governed by that provider's terms and policies.

We do not control and are not responsible for third-party outages, API changes, policy decisions, data handling, account restrictions, account suspensions, or other actions taken by those providers. An integration may become limited or unavailable without notice if a provider changes its technology, permissions, or policies.

Intellectual Property

Convershun and its licensors own the platform software, branding, designs, interfaces, documentation, and platform content, together with all related intellectual property rights. These Terms give you a limited, non-exclusive, non-transferable right to use the services during an active subscription for your internal business purposes.

You retain ownership of your logos, images, uploaded content, lead data, and business information. You grant Convershun the limited permission needed to host, process, display, and transmit that material solely to operate and improve the services you request.

Availability and Service Interruptions

The services are provided on an "as available" basis. We work to keep Convershun reliable, but maintenance, bugs, internet conditions, security events, third-party failures, and other service interruptions may occasionally affect availability.

We may perform planned or emergency maintenance and may change technical requirements when reasonably necessary to protect or operate the platform.

AI-Assisted Content Disclaimer

Convershun may provide AI-generated suggestions, recommendations, drafts, and content assistance. AI outputs may be incomplete, inaccurate, unsuitable, or similar to content produced for others.

You are solely responsible for reviewing, editing, approving, and lawfully using any generated content before publication or distribution. Convershun does not guarantee the accuracy, originality, legality, performance, or suitability of AI-generated outputs.

Limitation of Liability

To the fullest extent permitted by law, Convershun and its officers, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, business interruption, or third-party failures arising from or related to the services.

To the fullest extent permitted by law, Convershun's total liability for all claims arising from or related to the services will not exceed the amount you paid to Convershun during the three months immediately preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Convershun and its officers, employees, affiliates, and service providers from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising from your marketing practices, communications, uploaded content, violation of law or third-party rights, misuse of the platform, or breach of these Terms.

Modifications

We may add or remove features, modify the services, update pricing, or revise these Terms as Convershun develops. Updated Terms will be posted on this page with a revised Last Updated date.

When a change is material, we may provide additional notice where appropriate or required. Continued use of Convershun after updated Terms become effective constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute not subject to another binding dispute process must be brought in the state or federal courts located in Travis County, Texas, USA, and each party consents to the jurisdiction and venue of those courts.
